Throughout these Terms, "Aurore", "we", "our" and "us" refer to Aurore SASU.


2. Scope

These Terms govern all purchases made through the Website by consumers purchasing products for personal use.

By placing an order, you acknowledge that you have read, understood and accepted these Terms.

These Terms should be read together with our Terms of Service, Shipping Policy, Return & Refund Policy and Privacy Policy, which together govern your relationship with Aurore.

Nothing in these Terms limits any mandatory rights granted to consumers under applicable law.


3. Products

Aurore offers premium food products, including Medjool dates, chocolate-coated dates, stuffed dates, gift boxes and other gourmet products.

We make every reasonable effort to ensure that product descriptions, photographs and ingredient information accurately represent the products offered.

However:

  • product images are provided for illustrative purposes only;
  • colours may vary depending on screen settings;
  • packaging may change without affecting the product itself;
  • because our products are natural food products, slight variations in size, colour or appearance may occur.

Such variations do not constitute defects.


4. Product Availability

All products are offered subject to availability.

If a product becomes unavailable after your order has been placed, we will notify you as soon as reasonably possible.

Where appropriate, we may:

  • issue a full refund;
  • offer an equivalent replacement with your agreement; or
  • delay shipment until the product becomes available.

5. Orders

Submitting an order through the Website constitutes an offer to purchase.

An order becomes legally binding only once:

  • payment has been successfully authorised; and
  • we have sent an order confirmation email.

We reserve the right to refuse or cancel an order for legitimate reasons, including but not limited to:

  • suspected fraud;
  • payment issues;
  • pricing errors;
  • product unavailability;
  • violation of these Terms.

If payment has already been received, any cancelled order will be refunded promptly.


6. Prices

All prices displayed on the Website are shown in the currency indicated at checkout.

Unless otherwise stated, prices include applicable taxes where legally required.

Shipping charges, customs duties and any additional costs are calculated separately and displayed before the order is confirmed.

We reserve the right to modify prices at any time.

However, the price charged will always be the price displayed at the time your order is confirmed.


7. Payment

Payment is due in full at the time the order is placed.

We accept the payment methods displayed during checkout.

Payments are securely processed through trusted third-party payment providers.

Aurore does not store complete payment card information.

If a payment cannot be authorised, the order will not be processed.


8. Delivery

Delivery conditions, estimated delivery times, shipping methods and shipping charges are described in our Shipping Policy, which forms an integral part of these Terms.

Delivery times are estimates only unless otherwise required by applicable law.

Where mandatory consumer protection laws apply, your statutory rights regarding delayed delivery remain unaffected.


9. Transfer of Ownership and Risk

Ownership of the products transfers to you once full payment has been received.

For consumers, the risk of loss or damage passes only when you, or a person designated by you, physically take possession of the products.


10. Right of Withdrawal

Under Article L221-28 of the French Consumer Code, the statutory right of withdrawal does not apply to goods liable to deteriorate or expire rapidly.

As Aurore sells perishable food products, orders cannot be cancelled or returned simply because you change your mind after shipment.

This does not affect your legal rights if:

  • the wrong product was supplied;
  • the product was damaged during transport;
  • the product is defective;
  • the product does not conform to the contract.

11. Legal Guarantees

Consumers benefit from all mandatory legal guarantees provided under applicable law.

For customers purchasing in France, this includes in particular:

  • the legal guarantee of conformity; and
  • the guarantee against hidden defects.

These guarantees apply independently of any commercial guarantee that may be offered.

Nothing in these Terms limits your statutory consumer rights.


12. Liability

We take reasonable care to ensure the quality and safety of our products.

To the fullest extent permitted by applicable law, Aurore shall not be liable for indirect, incidental or consequential damages arising from the purchase or use of our products.

Nothing in these Terms excludes or limits liability where such exclusion would be unlawful, including liability for fraud, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.


13. Force Majeure

Aurore shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond our reasonable control.

Such events may include, but are not limited to:

  • natural disasters;
  • pandemics;
  • fires;
  • transport disruptions;
  • customs delays;
  • strikes;
  • governmental actions;
  • power failures;
  • supply chain disruptions.

Our obligations will resume as soon as reasonably possible after the event has ended.


14. Intellectual Property

All content available on the Website, including text, photographs, product images, graphics, logos, trademarks, packaging designs and other materials, remains the exclusive property of Aurore or its licensors.

No part of the Website or its content may be reproduced, copied, distributed or used without our prior written consent.


15. Personal Data

Personal information collected through the Website is processed in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR).


16. Governing Law and Dispute Resolution

These Terms are governed by French law.

Before initiating legal proceedings, customers are encouraged to contact us so that we may attempt to resolve the matter amicably.

Nothing in these Terms deprives consumers of any mandatory protections afforded by the laws of their country of residence where such protections apply.


17. Consumer Mediation

In accordance with the French Consumer Code, consumers may have the right to refer unresolved disputes to an approved consumer mediation service after first attempting to resolve the matter directly with Aurore.
